1. Who this applies to

These Terms & Conditions govern your purchase and use of Wi-Fi internet access vouchers ("Vouchers") sold by AnchorPoint ("we", "us") through this captive portal. By purchasing or redeeming a Voucher, you agree to these Terms.

2. The service

A Voucher grants time- and/or data-limited internet access at the location where it was issued, at the download/upload speed and data allowance shown at the time of purchase. Access begins when the Voucher is first redeemed on a device and ends automatically when its time or data allowance is exhausted, whichever comes first.

We do not guarantee uninterrupted or error-free service. Wireless internet service can be affected by factors outside our control, including but not limited to weather, power interruptions, upstream provider outages, and equipment on the premises.

3. Service availability and limitation of liability

The service is provided on an "as is" and "as available" basis. AnchorPoint does not operate its own international internet backbone. Like every internet provider in Saint Lucia, our service depends on connectivity purchased from upstream telecommunications carriers (including, without limitation, Digicel and Flow), on the local electricity grid, and on satellite and other infrastructure outside our premises and outside our control.

If an upstream carrier's network is down, degraded, congested, or otherwise unavailable, or if there is a power outage, storm, flood, hurricane or other severe weather event, fibre cut, satellite outage, government action, or other event beyond our reasonable control (a Force Majeure Event), our service may be slowed, interrupted, or entirely unavailable for the duration of that event. We are not responsible or liable for any Force Majeure Event or for any loss, inconvenience, or damage arising from it, including the unavailability of internet access, payment processing, or voucher redemption during that time.

To the fullest extent permitted by the laws of Saint Lucia, our total liability to you arising out of or relating to a Voucher or the service — however it arises, including in contract, tort (including ordinary negligence), or otherwise — is limited to the amount you actually paid for that Voucher, and we are not liable for any indirect, incidental, special, or consequential loss (including loss of business, data, or opportunity). Any claim relating to a Voucher or the service must be brought within twelve (12) months of the event giving rise to it, after which it is time-barred. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Saint Lucia, including under the Consumer Protection Act.

4. Expiry and refunds

A Voucher not yet redeemed does not expire on a fixed calendar date; its access window starts counting down from first redemption. Once redeemed, access ends automatically at the plan's time/data limit and the Voucher cannot be reused.

Saint Lucia's Consumer Protection Act (in force since 1 January 2022) and the Electronic Transactions Act, No. 16 of 2011, provide certain statutory protections for consumers in distance/online sales, including disclosure requirements and, for some categories of purchase, a cancellation window. Because internet access under a Voucher is typically consumed immediately or shortly after purchase, the applicability and scope of any statutory cancellation right to this specific service should be confirmed with legal counsel — this page describes our own refund practice, not a legal determination of your statutory rights.

Our practice: if a Voucher was purchased but never successfully redeemed due to a fault on our side (e.g. the network was down at the time), contact us (see the Contact page) and we will extend, reissue, or refund it at our discretion.

5. Acceptable use

You agree not to use the service for any unlawful purpose, to attempt to circumvent any bandwidth, time, or data limits, or to interfere with the network or other users' access. We reserve the right to suspend or terminate access for any Voucher used in violation of these Terms, without refund.

6. Information we collect at redemption

Redeeming a Voucher requires your first and last name, and at least one of a phone number or email address. See our Privacy Policy for what we collect, why, and how it's used.

7. Governing law

These Terms are governed by the laws of Saint Lucia, including the Electronic Transactions Act, No. 16 of 2011, and the Consumer Protection Act, without regard to conflict-of-law principles.

8. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the service after a change constitutes acceptance of the updated Terms.
